The memory and the document raise questions
A hypothetical spouse receives a guarantee demand and recalls being told the signature was only an administrative requirement. The available file includes a signed guarantee but little correspondence from that time. Preserve the evidence and obtain independent legal advice. Neither a troubling recollection nor a signature alone allows this article to determine the outcome of the dispute.
Write a factual chronology for the lawyer, identifying what the person remembers directly and what remains uncertain. Include where and when signing occurred, who was present and what documents were available. Do not coach the account or replace uncertainty with a more convenient version. Keep each person's recollection separate rather than constructing a jointly agreed story.
Moneysmart's loan-guarantor guidance recommends independent legal advice before giving a guarantee. If a guarantee is now disputed, give the lawyer the circumstances and documents for assessment. This article does not say that missing advice, pressure or misunderstanding automatically invalidates a guarantee. The relevant facts and law need individual review.
In the hypothetical example, search authorised email accounts and retained files for the covering message, document versions and any advice appointment records. Preserve originals and relevant metadata where available. Ask the lawyer how to request material held by others. Do not access someone else's private account or alter an old document to reflect what is now remembered.
Separate the evidence review from urgent response tasks
Send the demand and any stated response date to the lawyer promptly while gathering the history. Do not wait for every missing record before obtaining advice. Ask what needs to happen now and what additional material can follow. A developing evidence file does not itself pause a creditor's action or establish that a deadline has changed.
List documents requested, responses received and items still unavailable. CRP can help organise the business-side history for the appropriate advisers. The useful preparation is a reliable account of the signing circumstances and its limits, so the legal assessment rests on evidence rather than an assumed defence or a reconstructed memory.
