Understanding comes before agreeing

A collector calls about a business account, but you cannot confidently follow the language used to explain the proposed payment arrangement. Say that you need suitable language support. Do not agree to an amount or date simply to end an uncomfortable conversation. At the same time, keep the actual account and any formal documents moving to the appropriate adviser.

02 / 06

Explain the assistance needed

Ask for the account details and proposed terms in writing, together with a practical way to discuss them accurately. Identify the language assistance required without sending unrelated personal information. Keep a record of the request and response. Receiving a written document may help, but it does not resolve the problem if you still cannot understand its meaning.

Keep treatment respectful

The ACCC says debtors and others connected to a debt should be treated with fairness, respect and courtesy. Explain the communication difficulty clearly and seek advice if the response is inappropriate. This article does not decide who must pay for an interpreter or establish the legal effect of a particular call. The suitable arrangements need to fit the actual situation.

Clarify the helper's role

Imagine a business owner inviting a trusted adult to translate a conversation. Make clear whether that person is only interpreting or is also authorised to discuss a proposal. Do not assume speaking English gives the helper authority to admit liability, settle the account or promise company money. Any proposed representation needs clear authority and appropriate advice.

05 / 06

Check the message was understood

Ask for the final proposal to be confirmed accurately and review it with the relevant adviser before committing. Preserve any uncertainty about the words used rather than reconstructing a convenient version afterwards. If earlier communication may have been misunderstood, disclose that promptly. A translation question does not automatically remove an existing obligation or extend a response date.

06 / 06

Use a workable ongoing channel

Agree how future information will reach the right person in an understandable form, protecting account privacy. Keep translation support separate from legal and financial advice about what to do. The practical goal is meaningful participation in the discussion, so a language barrier does not turn a proposed arrangement into an uninformed promise or leave an urgent document unanswered.
