Two guarantors receive the same demand but may need different advice

The same envelope reaches two households
Suppose two former business partners receive demands connected with the same unpaid supplier account. One wants to pay immediately; the other disputes signing the document relied upon. They agree that the more confident partner will handle everything. Before anyone responds for both, each person should understand the claim against them and obtain advice about their own position.
Start with independent understanding
Moneysmart's loan-guarantee guidance recommends independent legal and financial advice about guarantee risks. A trade-credit guarantee must be assessed on its own facts. Ask the lawyer whether the interests of the people involved differ and what representation is appropriate. A common underlying debt does not establish that everyone has identical documents, concerns or authority to speak for another person.
Create separate document sets
Keep each demand, guarantee version and relevant correspondence identifiable. Record who received what and when. Preserve any document shared between the files without merging different histories into one account. In the hypothetical example, a signature question and a repayment discussion require different information. Make both issues visible instead of allowing one partner's preferred solution to define the other person's position.
Check what has already been said
Tell the adviser about calls, emails, offers or payments made by either person. Provide the exact correspondence where available. Do not assume a statement made on behalf of everyone was authorised, or that it has no consequences because authority is disputed. Explain the circumstances and let the lawyer assess their significance before sending a corrective message.
Clarify the scope of any proposal
If settlement is considered, ask whose obligations the proposed terms address and what remains outstanding. Have the documents reviewed before anyone signs or pays. Do not infer that resolving one person's position releases every guarantor or the company. Keep any separate discussions about contributions between guarantors subject to advice rather than improvising a private allocation in a group chat.
Give each person a clear next step
Record who is obtaining advice, responding and monitoring any deadline for each individual. Coordinate shared factual records where appropriate without treating coordination as a substitute for independent decisions. CRP can help organise the business account information. The outcome should be a deliberate response for each person, supported by the actual documents and the advice relevant to their circumstances.
