A routine reminder may not answer the deed

A hypothetical creditor has a signed settlement deed but receives no payment on the expected date. An employee prepares the usual overdue-invoice email and labels it a default notice. Before sending it as a formal step, give the deed and payment records to the lawyer. The appropriate response depends on the actual agreement and circumstances, not the label placed on an email.

Check the payment position first

Verify the relevant amount, date and any condition attached to payment. Reconcile receipts and ask about a genuine ambiguity through the advised process. Do not assume a missing remittance means no money arrived, or a remittance means funds cleared. Keep the factual payment record separate from the legal conclusion about default.

Review the contractual mechanism

Business.gov.au recommends clear contract terms and reviewing obligations carefully. Have the lawyer examine the deed's notice, default and remedy provisions together. This article does not prescribe a notice or establish that one is required in every settlement. Ask which action is appropriate, who must receive it and how compliance with the relevant process should be documented.

Use the correct current instructions

In the hypothetical example, the deed may identify an address or contact different from the person who negotiated the original invoice. Give the lawyer that information rather than substituting a familiar contact. Do not assume copying the debtor's salesperson satisfies a formal notice requirement. Any question about valid service or delivery needs assessment against the actual terms and law.

05 / 06

Preserve what is sent and received

Retain the authorised communication, attachments and delivery evidence. Record any response and forward it promptly to the adviser. Avoid adding threats or extra demands to wording that has been reviewed without checking the effect. A factual account of the missed payment is more useful than unsupported claims about automatic enforcement powers.

Confirm the next step after the notice

Ask the lawyer what must happen next and when the position should be reviewed. CRP can help organise the settlement and account records. The objective is to use the agreed and lawful process accurately, rather than turning an unpaid settlement into a second dispute over an improvised response.
