The restructuring moves into a plan: recheck the position on personal guarantees

The company process changes while the guarantee remains on file
The builder enters a restructuring plan and you still hold a personal guarantee. You remember being told that guarantee enforcement was restricted during restructuring. Ask your lawyer to reassess the position using the actual stage and documents. Do not assume the earlier restriction continues indefinitely, or that a change of stage proves your guarantee can be successfully enforced.
Confirm the event rather than its shorthand
Obtain the practitioner's notice or other reliable confirmation of what has occurred and when. Distinguish entering a plan from completing it, and from restructuring ending in another way. Keep the guarantee, account history and any earlier advice together. A comment that the builder is restructured may leave several legally significant events unclear.
Read the restriction with its stated endpoint
ASIC explains a moratorium on enforcing certain personal guarantees of directors, spouses or relatives during restructuring, subject to court leave. Its guidance says that moratorium stops when the plan is entered into or restructuring otherwise ends. Have a lawyer assess the actual guarantee and circumstances; the ending of that particular restriction does not resolve every defence, procedural requirement or other legal issue.

Consider a hypothetical stale instruction
Imagine a creditor file carrying an instruction to take no guarantee action because restructuring is underway. A later notice confirms a plan has been entered into, but the file is never reviewed. The useful response is to seek updated advice. It is not to automatically issue a demand or assume the guarantee debt disappeared because the company proposed a reduced return.
Account for receipts and separate rights
Give the lawyer details of payments already received and the plan terms relevant to the account. Ask how company recovery and any personal claim should be coordinated without seeking double recovery. Do not treat a proposed dividend as received cash or assume the personal obligation is reduced in precisely the same way as the company's obligations without advice.
Record the revised advice and next decision
Update the recovery file with the verified event, advice and authorised action or reason for waiting. Continue monitoring actual plan receipts separately. The practical task is to refresh a stage-dependent legal assessment when the underlying process changes, rather than letting an old restriction or a reassuring plan announcement stand in for current advice about the guarantee.
