The proposal is signed but not fully implemented
A hypothetical company signs a restructure outline and immediately lowers its next payment to the proposed amount. The lender says documents remain outstanding and the change is not yet effective. Before altering payments, confirm the actual status and conditions with the lender and adviser. A signature on one document may not answer when the complete arrangement starts.
Collect the offer, schedules and later correspondence. Ask which documents or actions remain required and who is responsible for each. Do not treat a checklist from an earlier proposal as the current requirement. If a condition is unclear, seek an explanation of its meaning and effect before assuming it is merely optional administration.
Business.gov.au's contract guidance emphasises clear obligations and terms. Have the proposed restructure reviewed by the appropriate advisers, including when the change takes effect. This article does not decide whether a particular document is binding or whether old terms remain enforceable. Ask the lawyer and lender to clarify the position under the actual arrangement.
In the hypothetical example, a requested document may have been sent but not accepted as satisfying the condition. Retain submission records and obtain confirmation of what remains outstanding. Do not mark a condition complete merely because somebody intends to provide the item. Where third parties are involved, record dependencies honestly rather than promising their approval.
Ask what payment is required while the outstanding conditions are addressed. Use the confirmed position in the cash forecast and show the proposed change separately where necessary. Do not reduce a debit or stop a payment solely on an internal assumption. If the current obligation cannot be met, seek prompt advice and communicate accurately through the agreed channel.
Retain the lender's confirmation of the effective terms and provide the verified schedule to accounts. CRP can help organise the commercial plan. The purpose is to carry an agreed proposal through its actual requirements so the business does not act as though relief has begun before the relevant position is confirmed.
