The file was emailed and the task was marked done
A hypothetical company prepares documents for a winding-up response and sends them to the person handling lodgement. The director assumes the court step is complete. Before relying on that assumption, ask the lawyer for the verified status and any remaining tasks. Preparing, sending, filing and serving documents can involve different actions that need clear responsibility.
Provide the actual application and orders to the lawyer and confirm what response is required. Identify which documents have been prepared and where they were sent. Do not rely on an internal checklist entry saying submitted without understanding what that means. If a deadline is close, explain the uncertainty promptly and obtain direct legal guidance.
The Federal Court's guidance sets out specific steps for winding-up proceedings based on unsatisfied statutory demands. Your lawyer must assess the actual court, documents and timing. This article does not prescribe a filing method or deadline. Ask what evidence confirms completion of each relevant step and whether any separate service requirement remains outstanding.
In the hypothetical example, a transmission receipt may show an email was sent but not establish that the intended court process was completed. Give the lawyer the receipt and any subsequent message. Do not resubmit or alter documents independently without checking, as competing versions can create confusion. Ask the responsible person to clarify the status through the proper channel.
Retain the version actually used and the relevant confirmation. Make sure the hearing team has the same documents. If an error or further requirement is identified, preserve the communication and ask how it should be addressed. Do not conceal a rejected submission or assume the issue disappears because the substantive argument seems strong.
Record who confirmed filing, service and any remaining attendance or preparation step. CRP can help organise the commercial background, while legal advisers manage the proceeding. The aim is to avoid a gap between a completed document and a completed procedural task when the company is relying on its response.
