The judgment names the company but the bankruptcy threat names you

Distinguish company judgment from personal guarantor judgment in threatened bankruptcy by comparing named parties and actual orders without assuming personal liability has been adjudicated.

The documents may concern different legal parties

A creditor refers to a judgment against the company while threatening to bankrupt you personally under a guarantee. Give the actual judgment and guarantee to your lawyer. Do not assume a court decision naming the company is automatically a judgment against every director or guarantor. Equally, do not assume the personal claim is baseless merely because different documents are involved.

Read the operative order

Identify the parties named, the court reference, date and orders made. Keep the sealed or otherwise official document rather than relying on a creditor's summary. Check whether there are other proceedings or orders concerning you that are not in the company file. Tell the lawyer what is missing so they can obtain the relevant material through the proper process.

Check the personal-notice requirements

AFSA's bankruptcy-notice guidance says the person included must appear on the judgment or order relied on. Ask the lawyer how the actual papers and any proposed process fit together. Do not use that general statement to pronounce a notice invalid yourself or ignore it. The complete history and available legal steps need urgent professional assessment.

Consider a hypothetical shared surname

Imagine a judgment naming a company whose trading name includes the director's surname. The creditor's email then addresses the director personally. Similar wording does not resolve which legal party the order concerns. The guarantee may still require assessment, but the evidence should distinguish the company obligation, asserted personal obligation and any personal judgment actually made.

Keep the guarantee merits separate

Provide the signed undertaking, relevant terms and debt history so the lawyer can assess personal exposure independently of the company judgment. Identify any payments or changes without altering the court documents. Do not assume the company losing its case answers every issue under the guarantee, or that the company judgment can simply be substituted for the personal process.

Respond to the actual position

Ask the adviser to identify the immediate response and obtain confirmation of any required step. Keep company and personal files linked but distinct. The practical aim is accurate identification of who has been ordered to pay what, so a bankruptcy threat is assessed on the real documents rather than on a loose reference to a judgment against the business.
