A combined folder can blur the amount being pursued
The ATO is taking personal recovery action, and your records include statements for you, a company and perhaps an earlier business. Ask the tax adviser and lawyer to identify the actual debt in the proceeding. A folder labelled ATO does not make every balance a personal liability. Nor does an old business label prove that an amount cannot concern you.
For each statement, record the taxpayer name, relevant identifier, account type, period and date. Handle identifiers securely and share them only through appropriate channels. Keep the documents unchanged. Do not combine totals merely because they appear in the same online login or were downloaded by the same bookkeeper; the adviser needs to see the source of each figure.
Business.gov.au includes tax and bank records in its record-keeping guidance. Give the advisers complete account transactions where available, together with the notices and court documents. A summary balance can conceal transfers, credits or different periods. Ask the tax adviser to explain the entries rather than treating every movement as a payment or a new liability.
Imagine a personal recovery demand accompanied in your own file by a current company activity-statement balance and an older personal income-tax account. Adding both numbers could overstate the amount being discussed, while omitting one without advice could miss a relevant issue. The example does not decide liability; it shows why account identity must precede a meaningful reconciliation.
Ask who will explain the assessments and account entries, and who will handle the personal recovery proceeding. Make sure both advisers work from the same identified records. Do not wait for a perfect tax reconciliation before obtaining urgent legal help with a notice or hearing. Any disagreement about liability and any procedural response need coordinated assessment.
Keep each figure linked to its account, period and supporting explanation. Mark unresolved items and give the lawyer a concise update when the tax adviser clarifies them. The aim is a dependable factual basis for the response, avoiding a misleading combined balance that treats every tax record associated with the business as the same personal debt.
