The evidence contains more than the disputed account
The lawyer asks for records ahead of a winding-up hearing, but the spreadsheet includes customer pricing and unrelated commercial details. Raise the sensitivity promptly while supplying the complete material securely to your lawyer. Do not withhold relevant evidence or assume writing confidential across a page decides who can see it once used in court.
Describe which information is sensitive, why and whose interests are affected. Separate genuine confidentiality concerns from embarrassment about the company's position. Tell the lawyer about any existing contractual restriction or personal information in the records. A specific explanation helps them assess the appropriate process; a blanket request that nothing become public may not address the court's requirements.
The Federal Court explains that access to civil court documents is governed by rules and may be subject to court conditions. Ask the lawyer how the relevant court handles the particular material and whether any application or direction is needed. Do not assume every document is automatically public or automatically protected, and do not treat commercial sensitivity as a guaranteed basis for restriction.
Imagine a director asked to support a cash-flow statement with a customer schedule containing confidential rates. The totals may matter to the proceeding, while the detailed rates raise a separate concern. Give the lawyer the intact schedule and identify the sensitive fields. They can advise what evidence is required and what lawful protection, if any, should be sought.
Do not delete columns from originals or submit a redacted version without advice about the proper procedure. Keep an unchanged source copy and a clear record of any authorised working versions. Confirm which version is approved for each recipient. An unexplained missing column can create evidentiary confusion without providing the protection you intended.
Flag the issue as early as possible and confirm responsibility for any necessary application or filing step. Follow the lawyer's instructions about distribution and retention. The practical goal is to present required evidence accurately while addressing a specific confidentiality concern through the court's process, rather than discovering after circulation that a private label had no assumed effect.
