Doing the work and proving it are separate tasks

Your team returns to site to address issues in a default notice. Afterwards, the builder says one item remains unresolved. Keep a precise record of the work against each allegation while obtaining advice on the notice and response. General progress photographs may show a busy site without establishing which corrective task was completed, when it occurred or what remains disputed.

Use the notice references

Imagine an electrical subcontractor receiving a notice listing three identified defects. Create a working record using those same item numbers. For each, identify the location, work performed and person responsible. Keep the original allegation intact rather than rewriting it to match what the team prefers to discuss. An unclear item should be referred for clarification through the advised process.

Preserve evidence as work occurs

business.gov.au recommends protecting business records and maintaining backups. Retain dated work records, relevant photographs and inspection documents in an organised file. Record who created them and what they show. Do not alter an earlier photograph or backdate a completion entry to suggest that a task was finished before it actually was. The record must reflect the real sequence.

Separate completed work from outstanding issues

In the electrical example, two tasks might be completed while the third requires access that has not been arranged. State that distinction accurately. Preserve access requests and responses for the adviser. Do not describe all notice items as closed merely because a crew attended, and do not assume that an access difficulty automatically changes the contractual response requirements.

05 / 06

Arrange the appropriate verification

Ask who should inspect or acknowledge the corrective work and what the contract requires. Keep the actual response, including any qualifications. A site employee's informal thanks may not be a formal acceptance or withdrawal of the notice. Send the proposed written response and supporting evidence to the construction lawyer so the position is expressed accurately.

Maintain the record through the outcome

If another inspection or task is required, add it with its true date and link it to the same item. Keep payment and other disputes distinguishable from this evidence trail. An itemised remedy record helps the business explain what it has actually done without claiming that attendance, photographs or an internal tick alone settles the contractual issue.
