Both sides say the handover is incomplete for different reasons
A hypothetical Victorian builder sends a final invoice after providing a handover folder. The homeowner says important documents are missing, while the builder believes everything was supplied. Establish exactly what is being requested and what was delivered. The document gap and the legal effect on payment are related questions that each need a clear answer.
Ask the homeowner to identify the particular records they say are absent. Compare that list with the contract, handover requirements and adviser guidance. Do not assume every requested document is required, or dismiss the request because the owner has already received a large folder. A specific list makes the practical problem easier to investigate.
Business.gov.au's unpaid-invoice guidance recommends reviewing the payment conditions in the contract. Ask the adviser how any unresolved handover requirement affects the final claim under the actual agreement and applicable Victorian rules. This article does not decide whether payment may be withheld or identify a universal list of required building documents.
In the hypothetical example, find the sent email, attachment list or signed handover record and check what it actually contains. A folder title does not prove a particular certificate was inside. Preserve originals and provide appropriate copies where available. Do not create or alter a certificate to make the handover record appear complete.
If a document exists with a consultant or subcontractor, arrange an authorised request and track the response. If it does not exist or its status is unclear, raise that honestly with the adviser. Avoid promising a delivery date that depends on somebody else's unconfirmed action. Keep the homeowner informed through a factual, appropriately reviewed update.
Record what was supplied, what remains unresolved and any acknowledgement received. Reassess the payment discussion with advice once the factual position is clearer. CRP can help organise the handover and account records. The useful step is to turn a broad claim of missing paperwork into identifiable items and verified actions, without assuming paperwork alone determines the dispute.
