Several letters arrive with one remembered cap
You receive demands concerning more than one company facility and remember signing a capped guarantee. Ask a lawyer to map the actual documents before adding the claims together or applying the cap separately to each letter. The scope may depend on the precise wording and transaction history. A repeated figure in correspondence does not answer how the obligations interact.
Imagine a director receiving letters about an overdraft and an equipment facility from the same finance group. Record the creditor entity, borrower, facility reference and amount in each letter. Match the documents relied on for each claim. Do not assume that similar branding means the same creditor or that one guarantee necessarily applies to every facility in the group.
business.gov.au recommends having unclear contract terms explained before relying on them. Give the lawyer complete guarantees, facility agreements and variations. Ask which obligations each document addresses and what any limit actually covers. Avoid multiplying or reducing the cap in your own spreadsheet as though the calculation settles a legal interpretation that has not yet been assessed.
In the director's example, the letters may refer to different debts or may repeat information about an overlapping obligation. Request appropriate breakdowns through the adviser and preserve payments or adjustments relevant to each account. Do not treat every letter as a new independent debt merely because it has a separate date, and do not disregard one because another arrived first.
Provide records of any earlier payout, replacement facility or proposed release. A document marked refinance may not by itself establish that every guarantee ended. Ask the adviser what confirmation is needed and what remains uncertain. Avoid signing a combined acknowledgement that obscures the distinction between the obligations while the cap and scope are still being reviewed.
Use a clear schedule linking each demand, agreement and calculation, with unresolved questions marked. Have the lawyer direct the response and timing. A facility map makes a complex guarantee review more manageable without turning a remembered cap into an unsupported rule about how much can be claimed across several different accounts.
