The remembered number may come from another document
The creditor demands more than the amount you thought you guaranteed. Before relying on the remembered figure, identify where it appears. A credit-account approval, a facility amount and wording in a signed guarantee may serve different purposes. Give the complete documents to a lawyer and ask what the actual guarantee covers rather than treating every limit in the file as interchangeable.
Imagine a director recalling a fifty-thousand-dollar limit from a supplier's welcome email. Preserve that email alongside the credit application, signed guarantee and associated terms. Mark the exact wording without adding your own interpretation. The lawyer needs to know whether the figure described account availability, a specific transaction or a limit on the personal obligation now being asserted.
business.gov.au recommends understanding contractual terms and seeking legal advice where they are unclear. Ask the lawyer to explain the relevant definitions and documents as a whole. Do not isolate a favourable number from one page while omitting other provisions or later agreements. Equally, do not accept the creditor's description of the limit without the underlying documents being assessed.
In the supplier example, the credit account may have increased or been used for additional orders. Preserve the correspondence and any documents signed at those stages. Tell the adviser what you recall and what the records show separately. Whether changes affect the guarantee is a legal question; a larger account balance should not be assumed either to expand or leave unchanged every personal obligation.
Obtain the claimed principal, interest, fees and costs breakdown. Keep this calculation separate from the question of which document establishes the relevant limit. A correct account total does not by itself resolve the guarantee scope. Ask the adviser what evidence and response are required, keeping any formal deadline visible while missing records are requested.
Have the lawyer identify supported points and remaining uncertainty before making admissions or signing a fresh arrangement. Keep the original limit reference in the file even if it does not mean what you first thought. The useful question is what obligation was actually undertaken, not simply which dollar figure is easiest to remember from the account-opening process.
