A guarantee claim should be checked against the signed documents and the circumstances. Identify specific issues rather than assuming that regret or business failure cancels it.

The guarantee claim is disputed
A supplier demands payment under a personal guarantee. The former director believes the document was limited, while the supplier claims a much larger account balance. There are also concerns about how it was signed. A useful review needs the original agreement, the account and the actual events, not only the parties’ competing recollections.
Request the signed guarantee, linked facility terms, variations and demand calculation. Keep electronic signing records and correspondence. Identify missing pages or versions clearly.
Prepare a chronology of signing, changes, default and demand. Include any advice obtained and the information supplied at the time. Do not alter or selectively present the record to make the story stronger.
Ask a lawyer to assess scope, execution, alleged representations, pressure, variations, releases and the amount claimed where relevant. The available legal arguments depend on the facts and applicable law.
Moneysmart’s guarantee guidance emphasises understanding the commitment and seeking advice. It is not a promise that a guarantee can be avoided because the consequences are now unaffordable.
Record demand and court dates. Have the lawyer confirm what response is needed while the merits are assessed. Reconcile payments and credits separately from arguments about enforceability.
Prepare a personal financial position in case negotiation is appropriate. Do not admit an uncertain balance or offer new security without advice merely to gain a short delay.
Compare the strength, cost and likely consequences of defending with a documented settlement proposal. Ask what evidence would materially change the assessment.
If settlement is reached, require precise release terms and keep proof of performance. If the claim is defended, follow the advised timetable. A sensible response follows the evidence rather than a blanket belief that every guarantee is either unchallengeable or easily defeated.
