Two processes are running at once

A hypothetical business owner is considering personal bankruptcy while also involved in an existing civil claim. They assume bankruptcy would make the hearing irrelevant. That assumption can leave important questions unanswered. Put the court case into the advice discussion early, including its current stage and the next listed event, rather than considering the debt decision in isolation.

02 / 06

Collect the actual court documents

Bring the initiating claim, response, orders and correspondence from your lawyer or the court. Identify who is involved and whether you are bringing or defending the claim. Record the next known event without trying to interpret its legal effect yourself. If documents are missing, ask how to obtain them promptly. A remembered hearing date is not a substitute for the court record.

Check what must still happen

AFSA says a person involved in legal action needs to inform their trustee and should contact the court to confirm whether attendance is still required in a pending case. The effect on a particular proceeding requires specific advice. Do not treat a general bankruptcy explanation as an instruction to ignore an order, discontinue a claim or miss a scheduled court event.

Coordinate the advisers' information

In the hypothetical example, the owner's litigation lawyer needs to know that bankruptcy is being considered, while the insolvency adviser needs the current case papers. Ask who will explain the interaction and communicate any required steps. Keep a record of advice and responsibility. Avoid assuming that one adviser has notified the other merely because both know the same client.

05 / 06

Distinguish a possibility from an actual change

Record whether bankruptcy is only under discussion or has actually occurred, and provide verified details when relevant. A pending application or a conversation about options may not change the current court position. Obtain clear instructions about what to do while the position is being resolved. If there is uncertainty close to an event, seek urgent legal assistance rather than guessing.

Maintain a single current action list

Keep the court tasks and the bankruptcy advice tasks together, with the responsible person and verified next step for each. CRP can help organise the financial information for the wider review. The aim is coordinated advice based on the actual proceeding, so that a decision about personal debts does not create an avoidable gap in handling existing litigation.
