Another creditor may stop its winding-up case while your debt remains unpaid

Assess whether an unpaid supporting creditor should seek its own procedural role when the original winding-up applicant stops pursuing the case, without assuming automatic substitution or priority.

You were relying on someone else's application

Another creditor brought a winding-up application against the company that owes you money. You now hear that the applicant may settle or stop pursuing it. Ask your lawyer promptly what this means for your own position. Monitoring the case is different from taking any procedural step available to you, and an unpaid account does not automatically place you in control of the proceeding.

Confirm the actual status

Obtain the relevant court information and correspondence through the proper process. Distinguish a settlement proposal from a completed payment, filed document or court order. Tell the lawyer about the next listed date and what you have already done as a creditor. Do not assume a conversation with the original applicant preserves a right to act later.

Ask about the applicable court procedure

The Federal Court's corporations forms include a notice for a winding-up application by a substituted plaintiff. Ask your lawyer whether any such step is available or appropriate in the actual circumstances and what evidence and timing apply. The existence of a form is not proof that you qualify or that the court will grant an application.

Consider a hypothetical applicant settlement

Imagine a supplier learns that the original applicant has been paid, while the supplier's separate invoice remains disputed. The supplier should give its own contract, account records and dispute correspondence to the lawyer. It cannot simply borrow the other creditor's position. The assessment must consider its own claim and the actual procedural circumstances.

Understand the commitment before proceeding

Ask about the purpose, cost, risks and alternatives of any proposed step. Keep funding instructions clear and avoid suggesting that acting first guarantees repayment ahead of other creditors. Winding-up proceedings have consequences beyond a private collection demand, so the lawyer should explain whether the proposed use of the process is appropriate.

Act on a specific advised decision

Record whether action will be taken, who is responsible and what deadlines have been confirmed. Continue checking the case status as advised. The useful decision is your own informed procedural response to the applicant's changed position, rather than assuming another creditor will keep pursuing a case that no longer serves its purpose.
