The company may be pursuing money elsewhere
The debtor says it has nothing left, but you know it was pursuing a claim against a customer or supplier. Give the appropriate adviser or liquidator the information you lawfully hold. A pending claim is not a bank balance. Its ownership, current status, prospects, cost and possible recovery all need assessment before anyone treats it as value available to creditors.
Record the case reference, parties and source of your information where available. Check whether the claimant is the debtor company or a related entity with a similar name. Distinguish an actual proceeding from a threatened claim or a commercial complaint. Do not obtain private case material improperly or present something overheard as a confirmed legal entitlement.
ASIC describes investigation and asset collection among a liquidator's functions. Provide the practitioner with the specific claim information and ask whether it is already being considered. The liquidator and relevant advisers can assess the company's position. Do not assume that being an unpaid creditor lets you take over the claim, direct the litigation or collect its proceeds personally.
Imagine a company claiming $300,000 in a dispute while saying its trading assets have gone. The claimed amount may be contested, subject to a counterclaim or expensive to pursue. Even success may not produce full cash recovery from the other party. Treat the figure as a claim amount until the actual position supports something more definite.
If appropriate, ask whether the matter is active, settled, discontinued or awaiting a decision, and what information can be shared. A report prepared months ago may no longer describe the case. Keep any funding request separate from the claim's face value. Obtain advice about a proposed contribution rather than assuming a large pleaded sum makes further expenditure worthwhile.
Record the lead and any reliable update without forecasting a successful result as certain. A pending claim may matter to an assessment of the company's affairs, but it does not establish a creditor return. The useful step is to ensure the existing proceeding is identified accurately so those responsible can evaluate it, rather than accepting either a confident recovery story or an unsupported claim of no assets.
