An interim control order arrives with the bankruptcy petition

Separate an interim control order from the pending creditor petition, obtaining advice on immediate operative directions without assuming a final bankruptcy order or unrestricted property control.

There may be an immediate order as well as a future hearing

You receive a creditor's petition together with an interim control order or documents referring to one. Send everything to your lawyer promptly. The petition seeks a future court outcome, while an order already made may require immediate attention. Do not put all the papers aside until the petition hearing or assume every document has the same legal effect.

Identify what has actually been made

Separate an application, draft proposed order and sealed or otherwise official order. Record the date, case reference and people named. Ask the lawyer to confirm the current position and obtain missing material where needed. A creditor's description that control has changed should be checked against the court document rather than accepted or dismissed without review.

Recognise the distinct document category

AFSA's guidance identifies interim control orders separately from petitions and sequestration orders. Have the actual terms explained, including what property, people or actions they concern. This article does not state the powers under any particular order. Do not assume that an interim measure has the same consequences as a final bankruptcy order or that no obligations arise before the hearing.

Consider a hypothetical routine transfer

Imagine a person intending to move funds between accounts after receiving an order but before speaking with the lawyer. They regard it as ordinary administration. The adviser needs to check whether the order affects that proposed action. The example does not decide whether the transfer is permitted; it shows why the operative directions need attention before dealing with potentially affected property.

Confirm the authorised communication route

Ask the lawyer who should contact any named trustee or other person and how requests will be handled. Preserve records and do not conceal, dispose of or alter property to avoid the process. If an instruction is unclear, seek prompt clarification through the appropriate channel instead of improvising an interpretation that suits an immediate cash need.

Track both sets of requirements

Keep the immediate order obligations and the petition response in a clear action list with responsible people. Obtain appropriate confirmation of completed steps. Complying with an interim direction does not itself decide the petition, and preparing a defence does not answer every immediate requirement. The practical goal is an informed response to each document according to the effect confirmed by legal advice.
