A Victorian payment claim has been rejected.

Preserve the claim and response dates immediately. The next step depends on what was served, not simply the word 'rejected'.

A lower schedule starts a time-sensitive decision

A Victorian subcontractor receives a payment schedule offering less than the amount claimed. The builder disputes several items, and the subcontractor starts preparing another invoice. Before doing that, the subcontractor needs to identify the available security-of-payment step and its timing. The existing claim, schedule and service records may matter more than a rewritten account sent in frustration.

Keep the claim and schedule together

Save the exact payment claim, attachments, service evidence and response received. Record when each document was sent and received. Include the contract and the work or supply records supporting the claimed amount.

Do not replace the original documents or assume that issuing another invoice restarts every opportunity. A date-and-document chronology gives an adviser or authorised nominating authority a reliable basis for identifying the applicable process.

Check the current Victorian scheme

The Building and Plumbing Commission explains that a claimant may seek adjudication when a payment schedule proposes less than the claimed amount. Whether that route is available in your matter depends on the scheme's requirements and the particular documents.

Victoria's scheme changed in 2026. Avoid relying on an old checklist or another state's process. Have eligibility, notices, service and the relevant deadline checked promptly against current Victorian guidance.

Answer the reasons actually given

Create a schedule matching each disputed item to the supporting contract term, instruction, measurement or invoice. Explain the calculation clearly. Do not add unrelated complaints that make the claim harder to follow.

If a genuine error exists, identify it honestly and obtain advice on its treatment. The aim is a supported response to the scheduled amount, not a larger claim assembled because the original was rejected.

05 / 06

Choose and complete the next step

Compare adjudication and other available routes with the amount, evidence and costs. If adjudication is chosen, establish which authorised nominating authority can receive the application and what needs to be supplied and served.

Keep negotiation separate from the procedural timetable. An offer to discuss the claim should not be assumed to extend a deadline. Assign one person to manage the documents and required steps so a potentially useful remedy is not lost while commercial discussions continue.
