Your business is not a party but receives a subpoena

A supplier's legal dispute produces a subpoena asking your business for project records. The issuing lawyer offers to receive the files directly. Before sending anything, give the subpoena to your own lawyer and establish the required response. Being outside the underlying dispute does not make the document an ordinary customer request, and a convenient delivery suggestion may not match the applicable process.

02 / 06

Preserve the document and relevant records

Keep the subpoena, service details and attachments together. Identify the named addressee, requested categories and compliance details without editing the original. Preserve potentially relevant records through an authorised process. Do not delete material because it seems commercially awkward or decide unilaterally that the request can wait until the underlying parties settle their dispute.

Use the actual court procedure

The Federal Court's subpoena practice note says that, unless otherwise ordered, required documents are produced to the Court rather than the issuing party. It also addresses objections and production arrangements. Ask your lawyer how the subpoena, any orders and current requirements apply. This article does not provide a procedure for every court or determine whether this particular subpoena is valid.

Raise sensitive material before disclosure

Imagine the requested folder includes customer pricing and advice from the company's lawyer. Identify those concerns for legal assessment rather than emailing the entire folder to the opponent. Confidentiality, privilege and the scope of the request require proper consideration. Do not assume that marking a document confidential automatically excuses production or guarantees that nobody else can inspect it.

05 / 06

Organise an accurate production record

Follow the advised process for identifying responsive documents, permitted copies and any required accompanying information. Keep a record of what was supplied, where and when, without silently substituting an incomplete folder. Explain missing records honestly. Ask how significant retrieval costs or practical difficulties should be raised instead of treating them as permission to ignore the subpoena.

Confirm completion through the correct channel

Retain the relevant confirmation and any further directions with the legal file. Make sure staff understand what remains unresolved and who handles subsequent requests. The useful safeguard is a verified court response, with appropriate concerns raised in time, rather than assuming that sending some files to the person who asked for them completes every obligation.
