The rescue discussion has not paused the lease calendar
The business is comparing restructuring options when someone notices a lease option date approaching. Management assumes the decision can wait until the broader plan is complete. Give the lease and timing information to the lawyer promptly. Reviewing the business does not itself establish that a contractual window has moved or that continued occupation will preserve every option.
Collect the signed lease, amendments and relevant correspondence. Identify what the document says about the option period, notices, conditions and parties. Do not use a reminder copied from the previous tenancy as the authority. Ask the lawyer to determine what action, if any, is required and how it must be communicated in the applicable circumstances.
Business.gov.au recommends understanding contractual obligations and obtaining advice about unclear terms. Apply that discipline to exercising an option as well as allowing time to pass. This article does not establish a right to renew, determine the effect of an invalid notice or advise whether the business should take another term. Those decisions need the actual lease and financial position.
Imagine the proposed recovery would use a smaller workshop, while exercising the existing option may commit the business to its current premises for longer. Give the adviser the operating plan, relocation assumptions and supported costs. Do not treat another term as a cost-free way to keep choices open, or assume moving is practical before alternatives have been assessed.
If more time is needed, ask the lawyer how to approach the landlord. Preserve the actual response and distinguish a discussion from an effective agreement. Do not assume a friendly acknowledgement or ongoing rent payment changes the notice requirements. Keep the original date visible until advice establishes a different position, and escalate missing information promptly.
Record the advised decision and its implementation
Confirm who is authorised to decide and who will carry out any required step. Retain the final notice or agreement and appropriate delivery evidence if action proceeds. The early restructuring review should bring time-sensitive premises choices into view, so the business neither loses an opportunity by accident nor takes a major new commitment without understanding its effect on the rescue plan.
