A direct payment can change an active file

You hold an unpaid judgment and the lawyer is taking enforcement steps. Then the debtor sends money directly to your business account. Tell the lawyer promptly, with the payment evidence. Do not assume the enforcement team sees your bank feed or that a receipt automatically stops every step already underway. Ask what needs to be updated under the actual court process.

Identify the receipt accurately

Imagine a creditor receiving a payment with only the debtor's surname as a reference. Check the amount, date and any accompanying message against the judgment and other accounts. Flag an uncertain allocation rather than silently applying the money to whichever invoice is oldest. The adviser needs to know whether the payment relates to the judgment, another transaction or an unresolved proposal.

Maintain the supporting transaction record

business.gov.au recommends accurate records of income and bank transactions. Keep the original receipt and correspondence with the judgment file. Ask the accountant and lawyer how the payment should be reflected, including any interest or costs questions. A bank credit establishes receipt of money, but it may not resolve the legal allocation between components of the outstanding amount.

Update each authorised recovery channel

Tell the people actually handling the matter what has been received and ask who is responsible for any required formal update. Do not send inconsistent balances to different advisers or assume a collector and lawyer automatically share every message. In the creditor's example, an instruction prepared before the receipt may need attention even if the internal ledger has already been corrected.

05 / 06

Keep part payment distinct from completion

A smaller receipt may reduce the outstanding amount without satisfying the judgment. Have the remaining position checked before confirming that the matter is closed or demanding the original total again. Preserve any settlement terms relevant to the payment. Do not improvise a release simply because the debtor describes the transfer as the final amount.

06 / 06

Reconcile before the next instruction

Use one current, explained balance for further decisions and retain the earlier versions. Ask the lawyer to confirm what actions remain appropriate and any completed notifications. Prompt receipt reporting helps keep enforcement proportionate to the actual outstanding position. It prevents a legitimate recovery effort from being undermined by a payment that arrived but never reached the people acting on your instructions.
