Two urgent decisions meet at once

Imagine a director receives a personal guarantee demand while a home refinance application is underway. The director starts considering whether the expected refinance could fund a settlement. Neither the demand nor the new finance has been fully assessed. Bring both sets of documents to the relevant advisers before making a promise that depends on borrowing against the home.

Understand the guarantee's financial relevance

Moneysmart explains that a loan guarantee can affect later borrowing and says existing loan guarantees should be disclosed to a prospective lender. It also warns about assets used as security. Your supplier demand and refinance need advice on their particular circumstances. Do not assume a lender's earlier indication remains applicable after new information about a personal claim emerges.

Separate the amounts and purposes

List the current home loan, proposed new borrowing, estimated costs and funds you expect would remain available. Keep the guarantee amount claimed separate from any liability your lawyer has actually assessed. In the hypothetical example, an attractive refinance headline may include repayment of existing debt and fees, leaving less money than the director initially expected for a possible settlement.

Provide accurate information to advisers

Give the mortgage adviser or lender the information required about the guarantee and demand, and ask what further disclosure is needed. Provide the lawyer with the proposed funding documents and timeline. Avoid sending different versions of the situation to each person. They need consistent facts to explain the implications of the decisions being considered together.

05 / 06

Do not treat approval as available funds

Identify remaining finance conditions, settlement requirements and timing uncertainties. Ask for advice before offering a creditor a payment date dependent on those events. Also have any settlement terms checked for their effect on the guarantee. The possibility of borrowing does not answer whether the claim is valid or whether using that borrowing is appropriate for your circumstances.

Make the decision with both positions visible

Review the personal obligations, household commitments and proposed agreement with qualified advisers before proceeding. Keep written confirmation of any accepted terms and funding status. CRP can help organise the commercial information behind the demand. The immediate objective is to avoid one pressured response creating another commitment that has not been understood or realistically funded.
