A freezing order may require information as well as restraint

Identify ancillary information requirements in a freezing order and preserve asset records without assuming stopping transfers alone fulfils the order.

Stopping payments may not complete the response

After learning of a freezing order, the business focuses on preventing transfers. Read the rest of the document with a lawyer immediately. It may contain requirements concerning information or other steps as well as restrictions on assets. Do not assume compliance is complete merely because the affected bank account is no longer being used.

Mark each operative requirement

Give the lawyer the full order and any later versions. Ask them to identify the actions required, the people responsible and the actual timing. Keep questions about unclear wording visible. Do not calculate a response date from a generic example, and do not assume that a request for clarification suspends a requirement in the order.

Recognise ancillary directions

The Judicial Commission of NSW discusses ancillary orders, including asset disclosure. The precise requirements and protections depend on the actual matter. Obtain advice on what must be provided and how. A general asset spreadsheet may help organise facts, but it is not automatically the required response or a substitute for the procedure applicable to the order.

Use a hypothetical information issue

Imagine a director receiving an order that contains both dealing restrictions and a requirement to provide specified asset information. The director tells accounts to stop transfers but does not send the rest of the document to the lawyer. The example shows a possible missed task; it does not prescribe the form or scope of disclosure in another case.

05 / 06

Preserve records without altering the picture

Gather relevant account, asset and ownership records through authorised access. Keep originals and identify uncertain items. Do not move assets, change descriptions or omit information to make the position look simpler. Ask the lawyer how to handle sensitive or privileged material and any legal objection; do not make that assessment by withholding documents without advice.

06 / 06

Track the advised response separately

Record who is preparing the information, what remains missing and what has actually been submitted. Keep evidence of compliance and any further directions together. Continue monitoring the restrictions as well. Treating information duties as their own workstream helps prevent the visible banking problem from obscuring other requirements that may be just as important under the actual court order.
