Agreement in principle is not the final question
A creditor says it will consider releasing your guarantee once certain steps are completed. Have the proposal reviewed and identify exactly what those steps are. Do not treat a helpful conversation as confirmation that the personal obligation has ended. Ask your lawyer what the document requires and what evidence should confirm the release takes effect.
Imagine a director selling their interest in a business while the lender requests a payout and replacement documents. Record the required actions, responsible people and proposed timing. Distinguish things you can complete from things controlled by the buyer, company or lender. An incomplete step elsewhere in the transaction may affect the expected outcome.
business.gov.au recommends clear contract language and explanations of terms that are not understood. Apply that approach to the proposed release with your own lawyer. Ask which obligations, facilities and periods it addresses. Releasing one guarantee should not be assumed to resolve a different personal undertaking or security arrangement unless the documents establish that position.
Keep payment confirmations, executed documents and relevant correspondence together. Record any difference between the agreed condition and what occurred. In the director's example, a payment made after the quoted payout date may need checking. Do not tick a condition complete merely because somebody has said the money should have arrived.
Ask the appropriate party to confirm outstanding items and have changes reviewed before relying on them. If the transaction timetable moves, check whether the release proposal needs amendment. Avoid giving new personal assurances during a hurried attempt to finish the process. A change intended to solve one missing condition can create another obligation if it is not understood.
Ask your lawyer what completed documents should be kept and whether anything further is required. Update your guarantee records only to reflect the confirmed position. The checklist supports completion of the agreed process; it does not create a release by itself. A properly documented outcome is more useful than a memory that the creditor sounded satisfied on the phone.
